ROLE:

Involves actively managing the implementation of our core commercial objective which is to “manage value and control cost without compromising our contractual obligations and the standard of service we offer to our clients”.

• The Regional Commercial Director is expected to use his best endeavours to ensure the accuracy and the reliability of information presented to the Regional Board and the Construction Board. In doing so the commercial, legal and risk aspects of tenders and live projects must be reviewed in detail frequently.

• They must act as a custodian of the commercial, legal and risk processes/procedures laid down by the Company via its Internal Control and Risk Management Policy, implementing them within their respective business units, reporting on them and auditing compliance.

• Be responsible for ensuring tender risk is managed consistently throughout the bid process right through to Contract signing.

• Ensure early identification of “challenging” contracts and ensure recovery plans are formulated managed and reviewed in detail on a monthly basis as a minimum.

• Ensure that across the business unit, subcontractors, labour, plant and materials are procured in a risk averse and cost effective manner, as per the Company’s procedures.

• Ensure that an appropriate change management regime is implemented on all contracts taking account of the conditions precedent applicable to that contract.

• Plan and manage the recruitment requirements re QSs for the Business Unit’s ongoing needs, with a view to the BU’s medium to long term objectives.

• Ensure a plan is in place to deal with the ongoing training development of the business’s surveying cohort. The RCD shall liaise with the Group Commercial Director and the Training Department in this respect.

• Manage the Business Unit’s overheads within defined budgets and report on same as appropriate to the Construction Board.

• Actively contribute to Knowledge Sharing initiative in terms of commercial and contractual issues.

• Be familiar with the requirements of the Company’s Internal Control and risk management Policy and ensure that systems are in place in the Business Unit to ensure the requirements of same regarding authority limits, notifications and approval are complied with.

• Play a role in ensuring that we only pursue new tender opportunities that are appropriate with respect to the Company’s views on risk and the Business Unit’s Business Plan.

• Ensure each contract maintains a cash positive position.

• Present to the Board verified, reliable and accurate financial predications at any given time.

• Ensure that there is an appropriate level of useful feedback and input both ways between the bidding team and the operations team during the procurement stages of the projects.

• Ensure that the company Valuation Policy and Procedures are fully observed and implemented on all contracts.

• Ensure that our sub-contracting policy as set out in the Project Execution Plan guidelines is fully implemented.

• Able to interrogate and identify risks, opportunities and trends.

• Able to supervise the preparation and scrutiny of long term cash forecasts, monitor results and interpret reasons for deviation. Able to advise and guide on established techniques to minimise outflow of cash and maximise inflow. Has the big picture on cash management and guides the management of cash to maximise benefit to the group.

• Able to interpret complex project cost reports. Can quickly and accurately correlate project data to business priorities and lead pursuit of project opportunities and defence against risks by foreseeing trends and bringing extensive experience and knowledge.

• Able to lead, monitor and guide at functional level the preparation of full quantification and cost data preparation for multiple complex projects accurately and swiftly.

• Able to autonomously negotiate/resolve difficult final account claims with all parties to the contract to optimise commercial benefit to the company

.• Able to interpret complex contractual clauses for bespoke contracts. Fully conversant in, and has the ability to negotiate in industry terms, Bonds, Warranties, Guarantees, Insurances, letters of intent and other contractual mechanisms.

• Able to lead the commercial negotiations and management of a major PFI scheme.

• Able to develop and promote innovative project procurement solutions, complemented with a suite of suitable supply chain arrangements.

• Able to understand network analysis and is capable of interrogating programmes and analysing their logic.

• Proven ability to lead multiple large scale projects across the clients business.

• Contributes to shaping, influencing and developing HSE & CR, recruitment, design process and project risk management components to ensure best economic solutions are achieved for all stakeholders and clients.

• Empowers and influences teams, enrolling all stakeholders to own the HSE agenda and to challenge and change working practices to improve safety performance across the industry.

• Engages effective communication and feedback to ensure a consistent approach across all stakeholders consistent with the clients stated HSE policies.

• Anticipates and implements initiatives to meet changes in client and stakeholder needs and expectations.

• Creates and maintains a diverse network of contacts inside and outside the clients; uses these proactively to expand their thinking within their role, and encourages others to do the same.

• Recognised as a trusted advisor to clients by knowing their business and strategic drivers.

• Identifies critical relationships and strategically anticipates and manages potential conflict and disagreement, creating understanding and resolutions from difficult or complex interpersonal situations.

• Scans the broader client and stakeholder environment to identify and form effective sustainable working relationships with people from different levels, cultures or backgrounds.

• Promotes the essentials of the clients’s Strategic roadmap and its integrated delivery model to a non-technical audience, including why it is important for all employees of the client to have an understanding of these and the systems used to support them.

• Brings new insight and provides powerful motivation to support performance and capability development in others.

• Challenges and shapes plans to create strong alignment between the company, business unit and individual activities / objectives.
